The Prosecutor's Office investigates the vexatious treatment received by Zanchetta while his life was in danger in the hospital
The Public Prosecutor's Office of Salta has decided in to make charges of the crime of "aggravated humiliation due to the use of violence", and decrees the "summons to an indictment hearing against the staff of the Penitentiary Service" for the above-mentioned crimes. The prelate far from receiving favourable treatment, had his rights violated, while it was proven, both by private doctors and the judiciary, that his life was in danger During his stay in prison, he was denied access to the sacraments and the resolution of his medical request was delayed, despite the doctors' warning that his life was in serious danger.
Neither preferential treatment nor protection. The bishop emeritus of Oran, Gustavo Zanchetta, who is still awaiting the outcome of his appeal (as his sentence is not final), was chained to his bed during his stay in the clinic where he was being treated for a multi-organ disease. Now, the Public Prosecutor's Office of Salta has decided to charge the prelate with a crime of "aggravated humiliation due to the use of violence", and decrees the "summons to an imputation hearing against the personnel of the Penitentiary Service" for the above-mentioned crimes.
This shows, contrary to what some media falsely claimed, that Zanchetta, far from receiving favourable treatment, was able to have his rights violated, while it was proven, both by private doctors and the judiciary, that his life was in danger. However, it took weeks for his request to be resolved, and when it was, he was chained to a hospital bed, in a room with no windows and with an armed guard less than half a metre away from him. Now the justice system is trying to clarify the reasons for this cruel treatment, which is far from the preferential treatment that was reported at the time.
Furthermore, as RD has learned, during his stay in prison, he was denied access to the sacraments, and the resolution of his medical request was delayed, despite the doctors' warning that his life was in serious danger. These facts, together with some alleged serious irregularities denounced by the defence (they state that, among other things, the investigation against him began without prior complaint, taking statements from several people until one accused the bishop emeritus, and outside the timetable that guaranteed the presence of a lawyer) begin to paint a picture that has yet to be resolved, but of which it seems that many questions remain to be clarified.

At the time, and by presentation of the defence of the then bishop of the Diocese of Oran, Gustavo Oscar Zanchetta, it was denounced the chaining to the bed to which his client had been subjected in violation of national and international human rights regulations on the treatment of persons deprived of their liberty; the use of shackles and handcuffs as an element of restraint to the bed in the clinic where he was being assisted for an episode of multi-organ affection was questioned in that presentation; on that occasion the referral of relevant pieces to the corresponding Prosecutor's Office was ordered.
It should be recalled that on that occasion, which occurred in 2022, the Bishop emeritus of Oran had been transferred to a clinic due to an aggravating episode of his basic clinical condition -multi-organ cardiac events and arterial hypertension-. These circumstances were doubly corroborated by both private medical personnel and the Salta Judiciary, as it was stated by the professional of the Medical Service of the Oran Judicial District that he was "a high risk patient due to the multi-organic affection he has, (...) all this type of pathologies (...) all this type of pathologies (...) are of a high risk".) all these types of pathologies (aneurysms) develop over time because they can grow (...) and in a peak of stress, which brings with it arterial hypertension, can produce a rupture of the aneurysm with a cataclysmic haemorrhage (...)".
Following the intervention of the Human Rights Prosecutor's Office, the corresponding investigations were initiated, gathering photographic elements, requesting the corresponding reports from the Prison Service and other elements relevant to the preliminary investigations conducted by the said Prosecutor's Office.
Once these elements had been examined, the Prosecutor's Office considered that there were sufficient elements of suspicion to bring charges for the crime of aggravated vexation through the use of violence, given that the health condition of the then Bishop constituted an eminently predominant risk factor, contrary to the provisions of the manual of procedures for persons deprived of their liberty for these conditions that could aggravate the health of the patient, not covered by any cause of justification or reasonableness. For this reason, the opening of the proceedings was ordered today, by means of the decree of summons to an indictment hearing against the Penitentiary Service personnel for the aforementioned offences.
