Two Bishops stand up for life in Germany. All other Bishops missing in action.

Bishop Dr. Stefan Oster SDB and Bishop Dr. Rudolf Voderholzer on the election of the three judges to the Federal Constitutional Court on July 11, 2025, in the German Bundestag: Our Basic Law is maximally inclusive. Every person, regardless of their life situation, is granted human dignity and the right to life. Exclusions from this cannot and must not occur under any circumstances. It is the duty of the state to guarantee this unconditionally.

Anyone who holds the view that the embryo or fetus in the womb has no dignity and only a lesser right to life than a person after birth is conducting a radical attack on the foundations of our constitution. They must not be entrusted with the binding interpretation of the Basic Law.

Any relativisation of Article 1 of the Basic Law must be an exclusion criterion for election as a judge to the Federal Constitutional Court.

There must never again be second-class citizens in Germany.

Background

With their criticism, the two bishops are obviously referring to the lawyer Frauke Brosius-Gersdorf, who was proposed by the SPD. During the last parliamentary term, she was the deputy coordinator of a commission set up by the federal government to examine a possible liberalisation of abortion regulations. Among other things, the lawyer explained that there were good reasons why the full guarantee of human dignity should only apply from birth.

Parts of the CDU/CSU have also strongly criticised the lawyer's nomination. The CDU/CSU and SPD have agreed that Brosius-Gersdorf cannot become either President or Vice-President of the Federal Constitutional Court. A two-thirds majority in the Bundestag is required to elect the judges on Friday. The election is secret. The other two candidates are the Munich law professor Ann-Katrin Kaufhold and the judge at the Federal Labour Court, Günter Spinner.
