Canon lawyer believes leading supporter of Pope in Conclave violated the oath of secrecy

While the conclave assistants’ oath of secrecy set out in UDG 48 binds both in conscience and under penalty of law (Canon 1399 per UDG 48, excommunication per UDG 58), a cardinal elector’s oath (UDG 53) gravely binds only in conscience, not under penalty of law; electors who violate the oath they took in public (nb: before Extra omnes is called, per UDG 52) are accountable to God for their deed.*

Enforcing conclave secrecy is very difficult, and there is always a tendency to up the penalties when enforcement of a law is problematic. But, considering the range of information that could be leaked, I think that excommunication, a one-size-fits-all sanction, is too severe. Interdict seems more reasonable, as does a just penalty under Canon 1399.

Catholic journalists should have no part in tempting an elector to break his oath. That would be to act as an occasion of sin in another. Repeating or reporting on information, however, alleged to have been leaked is not, in my opinion, a violation of law.

* (A) Cdl. Kasper, unprompted, stated “Cardinal Bergoglio was from the beginning my candidate and I have from the beginning of the Conclave voted for him.” This seems to me a direct violation of the terms of conclave secrecy. 

(B) Cdl. Mahony stated “when the first blank ballot was given to us, and when it was time to write down a name, something powerful—and strange—happened. I picked up my pen to write, and I began. However, my hand was being moved by some greater spiritual force. The name on the ballot just happened. I had not yet narrowed my thinking down to one name; but it was done for me.” This very odd comment does not, in my opinion, violate the terms of conclave secrecy, but it shows poor judgment

Cardinal Kasper's Progressive Pope

“I was overwhelmed by joy,” said Hans Kung, the dissenting European theologian, in a radio interview after the elevation of Pope Francis. “There is hope in this man,” gushed Kung, who predicted that Pope Francis will conform to the progressive interpretation of Vatican II and not follow the “line of the two popes from Poland and Germany.”

Leonardo Boff, one of the fathers of liberation theology, was quoted in the German press as saying that Francis is “more liberal” than commonly supposed.

Cardinal Roger Mahony took to Twitter to proclaim that the Church would move from high church to “low” church under Francis: “So long Papal ermine and fancy lace!”

The National Catholic Reporter approvingly quoted an unnamed Vatican diplomat as saying that “the Traditional Latin Mass brigade is finished.”

Esteban Paulon, president of the Argentine Federation of Lesbians, Gays, Bisexuals and Transsexuals, told the Washington Post that Pope Francis is “known for being moderate” and when “he came out strongly against gay marriage, he did it under pressure from the conservatives.” According to Sergio Rubin, whom the Post calls his authorized biographer, Pope Francis initially “urged his bishops to lobby for gay civil unions” as an alternative to gay marriage.

Reports on his compliance with Benedict’s authorization of wider use of the Traditional Latin Mass are conflicting, but it is safe to say that he was less than thrilled by it. According to columnist E.J. Dionne, “an American bishop noted that the choice of Francis would not be greeted as a clear victory by conservatives,” since on “liturgical issues, he has opposed those who seek to roll back changes instituted by the Second Vatican Council.”

It was telling that Pope Francis in his first address from the papal window pointed to Cardinal Walter Kasper as a theologian whom he admires. Kasper is known for his hyper-ecumenism and taste for theological novelty.

Cathcon-see Cardinal Kasper plotting an anti-Ratzinger Pope. Cathcon- the tension between Tradition and Vatican II which Pope Benedict attempted to resolve with the "hermeneutic of continuity" but at the same time making Vatican II a litmus test for orthodoxy will go unresolved. The "hermeneutic of continuity" can appear convincing as the break actually occurred sometime before the Council, theologically with the advent of "new theology" and philosophically sometime before that as scholastic theologians surrendered to a Kantian critique of Thomistic metaphysics.

 It will be no solution to trap the Church in the alleged golden age of the 1970s, for it was then that the catastrophe was truly unfolding.

And hopefully the Pope's devotion to Cardinal Kasper does not extend to the erection of a pseudo-diaconate for women which would only lead to more pressure for attempted ordination of women.

Cardinal Kasper also thinks the UK is a third-world country.

Among some of the musings--we need a Pope who: speaks at least six languages fluently; who has served as a pastoral priest and bishop for many decades; who has extensive administrative and financial experience; who is an intellectual and scholar; who is an ordinary person who can relate to people; who can relate to college graduates and to migrant farm workers; who can proclaim the Gospel of Jesus Christ in a way that attracts hundreds of millions of new followers; who spends hours each day in prayer, while appearing on numerous television programs; who can understand Latin, and be on Facebook and Twitter at the same time; who can engage young people while consoling the elderly; who can speak clearly about Angola in one moment, and Tibet in the next; who can overnight increase vocations to the priesthood and to religious life. And that's just the beginning of the list!

Cardinal De Paolis thinks Cardinal Mahony should have been advised to stay away

Velasio De Paolis, an Italian cardinal and Curial official, has responded to calls for the former archbishop of Los Angeles, Roger Mahony, to decline to attend the upcoming conclave, saying, “The common practice is to use persuasion. There is no more that can be done.”

“He could be advised not to take part only through a private intervention by someone with great authority,” the curial cardinal said, adding that ultimately “it will be up to his conscience to decide whether to take part or not."

De Paolis is one of the 117 cardinal electors and president emeritus of the Prefecture for the Economic Affairs of the Holy See. More pertinently to the issue, he is also Pontifical Delegate for the Congregation of the scandal-ridden Legionaries of Christ.

De Paolis insisted that he was not suggesting that Mahony not attend, or even that someone should try to persuade him. He told La Repubblica daily that under the laws of the Church, Cardinal Mahony “has the right and duty to take part.”

Vatican insists all cardinals must attend Conclave- even Danneels,Brady, Mahony and Rigali

The Vatican said Friday that the presence of the cardinals in the conclave to elect the new pope is an absolute requirement, while many of them criticized in pedophilia scandals are pressed by victims' associations not to go to Rome.

The first gives the impression of conservatism but under any pressure of any kind transforms less than miraculously into a liberal.
